General terms and conditions
The subject matter of the contract is tyres for vintage vehicles and classic cars; also other automobile accessories.
I. Offers and signing of contracts
1. Offers are always subject to change.
2. Orders assigned to us are only then binding for us when we have confirmed them in writing.
II. Cancellation policy
You may cancel your contractual statement in written form (e.g. fax, email) without giving reason and within 2 weeks. The time limit begins when the item is received at the earliest. To meet the cancellation deadline it suffices to send the cancellation notice or item within the time limit. Cancellations should be addressed to :

You are not required to send the items back.
We will have them collected by postal service.
We ask you to voluntarily tell us the reason for your return within your revocation note.
III. Legal consequences of cancellation
In the event of an effective cancellation each party should return the benefits received to the other party and any compensation for capitalised use (e.g. interest) should be reimbursed. If you can not or only partially return the received service or if you can only return it in a devalued state then you must compensate us for the value of the service. This does not apply to the surrender of goods if the deterioration of the goods is solely the result of their examination, as would have been possible for you do do in a shop. You can also avoid compensation by not using the goods as your property and abstaining from any action that could diminish them in their value. All items whether they are suitable for parcel shipment or not will be collected at your premises. You must pay for the return shipment if the received item corresponds to the item ordered and if the item to be returned does not exceed a value of 40 Euros.
IV. Prices
1. The prices shown in price-lists and advertisements are not fixed prices. The effective prices are the prices given in the contract to be signed.
2. The prices shown are in € (EURO) and are valid for shipment from the warehouse.
3. You will find Information on prices for post and packaging on the Internet portal.
V. Shipments
1. The mode of shipment is at our discretion unless a specific mode of shipment is agreed upon in advance.
2. Packaging is at cost price.
3. The delivery period and time of delivery are always non-binding.
Partial shipment is acceptable.
4. The delivery period begins when the order has been confirmed in writing or text form and when all possible technical questions have been answered.
5. In order to make the agreed delivery time possible it is necessary that the buyer fulfills all contract duties, especially concerning the adherence to agreed payment conditions and the punctual receipt of various documents that the buyer must provide.
6. Claims made by buyers because the agreed delivery period or -time was exceeded are limited to half of the agreed net price.
VI. Security
1. All goods delivered by us remain our property until the buyer has completely fulfilled all required payments as stated in the contract.
2. Until all required payments have been fulfilled the buyer is prohibited from pawning or selling the goods to a third party, unless the sale is part of a properly regulated business operation. If a third party has access to goods delivered by us on which our proprietary rights are still reserved, the buyer must inform us immediately and notify the third party of our proprietary right.
Irrespective of data protection regulations it is the buyer's duty to give us the necessary information for us to exercise our rights with respect to the third party.
3. In the case of a resale of delivered goods or goods still in stock upon which we still reserve proprietary rights, the buyer must assign his claim to payment of the amount in the original sale contract to MOR.
The buyer still has the right to collect the assigned claim in his own name but he must transfer it to us directly after collection.
VII. Payments
1. Companies that we don't know very well must pay cash on delivery or cash in advance.
2. If paying by bill on delivery it must be paid within 8 days of the billing date at the latest, granted that no other arrangement is agreed upon.
3. Compensation for our claims is only permissible with an indisputable or legally approved counter claim.
VIII. Warranty
The general legal warranty rights apply to all buyers. For the sale of used goods the warranty period is one year from the date of delivery, notwithstanding legal regulations.
IX. Special provisions
1. Parts that are sent in as a sample and parts that have become useless due to repairs or alterations are scrapped unless something else has been specifically agreed upon.
2. The tyres are manufactured in limited editions, primarily by non-European foreign manufacturers who have taken over former European production machinery or who have their own production machinery that was state of the art when first setting up. Therefore you can not assume that the tyres delivered to you conform to modern or former German quality standards. In this respect the standard of development and the valid norms abroad at that time are the quality standards for limited edition production.
Variations with regard to the modern or former German quality standards concerning the tolerance for static and dynamic imbalance as well as lateral- and radial force fluctuation are not to be considered as faults; they are contractually accepted.
This is also the case for other merchandise because here too the production is still at that former standard of development and the machines designed at that time are still used.
On signing the contract of sale the buyer expressly declares his agreement herewith. Any conflicting conditions the buyer may have are categorically excluded unless these other conditions are accepted by us in an individual agreement.
3. If we vulcanise a white sidewall onto a finished tyre we can't guarantee that there won't be a negative effect on the durability and safety of the tyre. Due to the condition of the tyre used or external influences while driving or a lack of care it is possible that the white sidewall strip that has been vulcanised onto the tyre may loosen slightly, turn yellow or become darker at the edges. Despite great care this is a circumstance that is not always avoidable. Damages of this sort are not recognised as faults.
X. Final provisions
1. The place of fulfillment for all duties arising from the contract is Holzkirchen.
2. Holzkirchen is the agreed place of jurisdiction for traders, legal entities, public legal entities or public assets.
3. Contractual relationships are under German law only. The CISG is unenforceable.
4. Buyers' terms and conditions are explicitly contradicted unless they correspond with the terms and conditions above.
5. 'If certain provisions in this contract should be ineffective or unfeasible or if they become ineffective or unfeasible after the contract has been signed, this does not affect the effectiveness of the rest of the contract. In the case of an ineffective or unfeasible provision the effective and feasible law, whose commercial purpose is most similar to that of the ineffective or unfeasible provision that the contractual partners were pursuing, shall come into effect. The above provisions apply accordingly if the contract should prove to be incomplete. § 139 BGB (German civil code) is excluded'.
